General Terms and Conditions (GTCs)1. Scope
1.1. These General
Terms and Conditions (GTC) apply to all business relationships between befix GmbH, Gewerbepark 1, 2325 Himberg, Austria (hereinafter "befix GmbH"), and its customers (hereinafter "Customer") in connection with the delivery of goods and the provision of services, in particular in the area of sustainable packaging solutions.
1.2. Deviating ,
Conflicting or supplementary general terms and conditions of the customer shall only become part of the contract if befix GmbH has expressly agreed to their validity in writing.
1.3 These Terms and Conditions apply
for both consumers and entrepreneurs within the meaning of Section 1 of the Consumer Protection Act (KSchG), unless expressly stated otherwise.2. Conclusion of contract
2.1. The presentation of the products
and services in the online shop of befix GmbH ( www.befix.at ) or in other media does not constitute a legally binding offer, but rather a non-binding catalog. By clicking the "Buy now" button in the online shop, the customer submits a binding offer to conclude a purchase contract.
2.2. The acceptance
The offer is accepted by befix GmbH through an express order confirmation via email or by delivery of the ordered goods. Until acceptance, befix GmbH reserves the right to reject the customer's offer.
2.3. The customer
is obliged to check the accuracy of the data provided (e.g., shipping and billing address) before submitting the order and to accept the Terms and Conditions by checking the appropriate box. 3. Prices and payment terms
3.1. All prices
Prices are in euros and, unless otherwise stated, exclusive of statutory VAT. Shipping costs are shown separately.
3.2. Payment

can be made using the payment methods offered in the online shop. befix GmbH uses a secure payment provider for online payment processing, which provides encrypted payment interfaces.
3.3. The customer
will be in default if payment is not made within 14 days of invoicing. In the event of default, befix GmbH is entitled to charge default interest at a rate of 4% pa for consumers or 9.2% pa above the base interest rate for businesses. 4. Delivery and Shipping
4.1 Delivery takes place
to the delivery address specified by the customer. befix GmbH is entitled to make partial deliveries, provided this is reasonable for the customer.
4.2. Delivery times
are specified in the online shop or in the order confirmation. Delivery times are non-binding unless they have been expressly agreed upon as binding.
4.3 Force majeure
or other unforeseeable events release befix GmbH from its obligation to deliver on time. The customer will be informed immediately in such cases. 5. Retention of Title
5.1. The delivered goods
remains the property of befix GmbH until full payment.
5.2. The customer
is obliged to treat the goods with care during the retention of title.6. Right of withdrawal for consumers
6.1. Consumers
According to the Consumer Protection Act (KSchG), customers are entitled to a statutory right of withdrawal of 14 days from receipt of the goods. The exact withdrawal conditions will be provided to the customer separately upon ordering.
6.2. The right of withdrawal
does not apply to goods manufactured according to customer specifications (e.g. personalized packaging or stickers).7. Warranty
7.1. The warranty
is governed by the legal provisions of the Austrian General Civil Code (ABGB), unless otherwise stipulated below.
7.2. For entrepreneurs
The warranty period is 12 months from delivery. Obvious defects must be reported in writing within 7 days of receipt of the goods. 8. Liability
8.1. befix GmbH
is liable without limitation for damages resulting from injury to life, body or health as well as for damages resulting from intent or gross negligence.
8.2 For other damages
befix GmbH is only liable for breaches of essential contractual obligations, whereby liability is limited to typical, foreseeable damage.
8.3 Liability
for the content of external links is excluded. The respective provider is solely responsible for the content of linked pages. 9. Loyalty Points Program
9.1. befix GmbH
offers registered customers a loyalty points program. For every €1 of net purchase value, 1 loyalty point is credited, corresponding to a value of €0.05.
9.2. Loyalty points
can be redeemed for vouchers within 6 months of being credited. Unredeemed points expire after this period.

The loyalty points program can be viewed on the website www.befix.at under "My Loyalty Points." 10. Data Protection
10.1. The collection, processing
and use of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).
10.2. Further information
on data protection can be found in the privacy policy at www.befix.at.11 . Final provisions
11.1 The law of the Republic of Austria shall apply
excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2. Place of jurisdiction for all disputes
The sole and exclusive place of jurisdiction for disputes arising from this contract is Korneuburg, to the extent permitted by law. For consumers, the statutory place of jurisdiction applies.
11.3 Should any provision of these Terms and Conditions
Should any of these provisions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. Contact: befix GmbH
